Allahabad HC denies bail to 4 accused in Lakhimpur case he Centre today filed its affidavit before the Supreme Court and stated that it wanted to re-examine and re-consider the provisions of Section 124A (Sedition law) of the Indian Penal Code (IPC). The Centre said it would re-examine and re-consider the sedition law, in the spirit of Azadi ka Amrit Mahotsav and the vision of Prime Minister, Narendra Modi. "We decided to re-examine & reconsider the provisions of Section 124-A IPC," the Centre said and urged it to "await the exercise...to be undertaken by the GOI before an appropriate forum where such reconsideration is constitutionally permitted. The Government of India has filed the affidavit in response to the Sedition matter stating that there is a divergence of views expressed in the public domain by the various jurists, academicians, intellectuals and citizens in general. The Centre submitted that the Prime Minister of India has been cognizant of various views expressed on the subject and has also expressed his views on various forums. "The PM believes that at a time when our nation is marking 'Azadi ka Amrit Mahotsav' we need to, as a nation, work even harder to shed colonial baggage that has passed its utility, which includes outdated colonial laws and practices," the Centre said. It submitted that the Govt has scrapped over 1500 outdated laws since 2014-15 and has also ended over 25000 compliance burdens which were causing unnecessary hurdles to people of our country.Various offences which were causing mindless hindrances to people have been decriminalised. The Govt submitted that being fully cognizant of various views being expressed on the subject the govt has decided to reexamine and re-consider the provisions of Section 124A of IPC and had asked the court to not invest time in examining the validity of the law and await the exercise of reconsideration. It is to be noted that on May 7, the Central Government had filed an affidavit before the Supreme Court in the batch of petitions challenging the constitutional validity of sedition law stating that the sedition law needed no reconsideration. Filing the affidavit before the Supreme Court, the Central government had said that the judgement in Kedar Nath Singh against the State of Bihar is a good law and needs no reconsideration. "We have gone through the entire case. Our reply is this. This judgement in Kedar Nath Singh against the State of Bihar is a good law and needs no reconsideration," the Centre stayed in its affidavit filed before the Supreme Court. The affidavit further stated that the judgement must be treated as a binding precedent requiring NEW DELHI, 9 MAY The Lucknow bench of the Allahabad High Court on Monday denied bail to the four prime accused in the October 2021 Lakhimpur Kheri violence case. He bench of Justice D.K Singh, while rejecting bail of Ankit Das, Lavkush, Sumit Jaiswal and Shishupal, observed that the incident might not have occurred if the Union Minister of State for Home did not make alleged utterances threatening farmers to chase them out of the district. The court said political persons should not make irresponsible statements because they are expected to conduct themselves in accordance with their status and the dignity of the high office they hold. It also emphasised that lawmakers cannot be seen as lawbreakers, and it is difficult to believe that the Deputy Chief Minister of the state was unaware that provisions of Section 144 Cr.P.C. were clamped and any assembly or gathering was prohibited. Notably, the court praised the Special Investigation Team for conducting a free, fair, impartial, and scientific investigation into the crime. The bench noted that the charge sheet revealed overwhelming evidence against the accused-applicant and coaccused for the commission of the heinous, diabolic, brutal, barbaric, depraved, gruesome, and inhumane crime. The top court expressed unhappiness on a political party approaching the Supreme Court with the matter and dismissed the matter as withdrawn and granted the petitioners liberty to approach the High Court with the issue. The two-judge bench of the Apex Court, head- ed by Justice L. Nageswara Rao and Justice B. R. Gavai heard Senior Advocate, P. Surendranath appearing for the petitioner. DGCA to probe boarding row at Ranchi involving child with special needs: Scindia SNS & AGENCIES NEW DELHI, 9 MAY AGENCIES Shaheen Bagh area demolition drive : SC refuses to entertain pleas The Civil Aviation Minister Jyotiraditya Scindia has ordered a probe in a boarding row at the Ranchi Airport wherein the IndiGo Airlines debarred a child with special needs and his family citing inconvenience to the other passengers on Saturday. Taking a serious view on the incident, the Minister assured a probe into the matter. Stating that 'there is zero tolerance towards such behaviour', Scindia said in a Twitter message on Monday, "No human being should have to go through this! Investigating the matter by myself, post which appropriate action will be taken." The incident happened at the Ranchi's Birsa Munda Airport and a video clip of the showdown went viral. Meanwhile, it is learnt that the Directorate General of Civil Aviation (DGCA) chief has sought a report from IndiGo on the matter. "The DGCA is probing this incident and it will take appropriate action," the officials aware of this development said. Explaining the sit- uation, the IndiGo airlines said that the child was in a 'state of panic' and they could not fly him and his parents until he calmed down. Reports also suggest that IndiGo'sgroundstaffimpliedthat the child with special needs was 'unfit to fly' and made inappropriate comparisons to the child as similar to the drunk passengers unfit to travel. "The airline made the family comfortable by providing them with a hotel stay, the family flew on Sunday morning to their destination. IndiGo prides itself on being an inclusive organisation, be it for employees or customers; and over 75K specially-abled passengers fly with IndiGo every month," IndiGo said in a statement. As per the data shared by the ministry, India’s recovery rate stands at 98.74% with 3410 patients having recovered in the last 24 hours taking the cumulative tally of recovered patients to 4,25,60,905.While the weekly positivity rate in the country currently stands at 0.82 percent, the daily positivity rate stands at 0.95 percent, as per the data. Besides, the health ministry stated, that the last 24 hours saw a total of 3,36,776 COVID tests being conducted taking the cumulative tests to over 84.10 Crore. Under the National vaccination drive, 190.34 crore vaccine doses have been administered so far.As per the data, COVID vaccination for the age group 12-14 years was started on 16 March 2022. So far, more than 3.05 Crore adolescents have been administered the first dose of the COVID vaccine. Similarly, the COVID precaution dose administration for the age group 18-59 years also started from 10 April 2022 onwards. More than 18.34 crore balance and unutilised Covid vaccine doses are still available with the states and UTs to be administered.
