His counsel had withdrawn the interim bail application from the Delhi High Court after the prosecution had raised the issue of maintainability. KOLKATA, 23 JULY West Bengal commerce and industry minster Partha Chatterjee was on Saturday arrested by the Enforcement Directorate(ED) in connection with the alleged teacher recruitment scam in the West Bengal School Service Commission and West Bengal Primary Education Board. The arrest comes after around 27 hours of intense interrogation of Mr Chatterjee, who was state education minister at the time of the alleged scam and multiple raids by the central probe agency in the course of which it seized Rs 21.20 crore in cash from the premises of his close associate, Arpita Mukherjee. Ms Mukherjee was also formally arrested by the Enforcement Directorate in the Saturday evening. The Bankshall Court in Kolkata granted the ED twodays’ custody of Mr Chatterjee, but he was taken to the SSKM Hospital later in this evening after he developed chest pain. His lawyers had requested the court to admit him to the SSKM though ED recommended for either the ESIC Hospital or Alipore Command Hospital. “I tried to speak to the Trinamul party chief (Mamata Banerjee) but did not get any response,” Mr Chatterjee, who is Trinamul Congress secretary general, told mediapersons while coming out of the of Joka ESI hospital where he was taken for medical tests after being arrested by the Enforcement Directorate. Ill-informed and agenda-driven debates on issues involving justice delivery are proving to be detrimental to the health of democracy,” said the CJI while delivering the Justice SB Sinha Memorial Inaugural Lecture in Ranchi on Saturday. On the issue of the rising number of media trials, CJI Ramana said,“It cannot be a guiding factor in deciding cases”. He said, “New media tools have enormous amplifying abil- K CJI NV Ramana with Chief Justice of Jharkhand HC Ravi Ranjan at the inauguration of Sub-Divisional Court at Chandil district, Ranchi on Saturday. In this process, justice delivery gets adversely affected,” the CJI added. "By overstepping and breaching your responsibility, you are taking our democracy two steps backwards. Print media still has a certain degree of accountability. Whereas, electronic media has zero accountability as what it shows vanishes into thin air . Still, worse is social media,” he said. The CJI also highlighted that these days, there is an increasing number of physical attacks on judges. “Can you imagine, a judge who has served on the bench for decades, putting hardened criminals behind the bar, once he retires, loses all the protection that came with the tenure? Judges have to live in the same society as the people that they have convicted, without any security or assurance of safety,” the CJI pointed out. The CJI also commented on the long-standing matter of contention of the judicial review of legislative and executive actions.“One gets to hear that judges, being unelected, should not get into legislative and executive arenas. But this ignores the Constitutional responsibilities that is placed on the judiciary. Judicial review of legislative and executive actions is an integral part of the Constitutional scheme. I would go as far as to state that it is the heart and soul of the Indian Constitution. In my humble view, in the absence of judicial review, people's faith in our Constitution would have diminished," he said. The CJI also stressed that it becomes a challenge to accept the false narrative surrounding the supposed easy life of a judge. Justice He congratulated the judiciary of Jharkhand for marking the golden jubilee of setting up of the Circuit Bench of Patna and extended wishes to the children who received scholarship under Project Shishu.
