Venkataramani, representing the Centre, on the appointment of Arun Goel as the Election Commissioner, saying what was the “tearing urgency, haste”, and why was the appointment made at “lightning speed”.A fivejudge Constitution Bench headed by Justice K.M. Joseph after examining the file on Mr Goel's appointment, also questioned the criteria adopted by the Law Minister in shortlisting four names from the Department of Personnel & Training (DoPT) database. Mr Venkataramani told the Bench that if it were to begin to doubt every step taken by the government in the process of appointment of the Election Commissioners, then it has implications on the integrity and independence of the institution. The Bench shot a volley of questions at the AG to which he contended that court should not hold a mini-trial on the appointment. However the bench asked him to explain why the appointment was made with such haste.“Same day process, same day clearance, same day appointment, lightning speed, what kind of evaluation?" the bench asked.Justice Joseph specif- NEW DELHI, 24 NOVEMBER he Supreme Court on Thursday agreed to reconstitute a Constitution bench to hear a clutch of petitions challenging the constitutional validity of the practice of polygamy and ‘nikahhalala’ among Muslims. On 30 August, a fivejudge Constitution Bench comprising justices Indira Banerjee, Hemant Gupta, Surya Kant, M.M. Sundresh, and Sudhanshu Dhulia had issued notice on the petitions. However, two judges ~ Justices Banerjee and Gupta ~ have retired now. On Thursday, one of the petitioners, advocate Ashwini Upadhyay, mentioned the matter before a Bench headed by Chief Justice D.Y. Chandrachud and comprising justices Hima Kohli and J.B. Pardiwala, which said it will form a new bench. A total of nine petitions have been WOMEN’S RIGHTS T Nikah halala also known as tahleel marriage, is a practice in which a woman, after being divorced by triple filed challenging the constitutional validity of the practice of polygamy and ‘nikah-halala’. Polygamy allows a Muslim man to have four wives, and once a Muslim woman has been divorced, her husband is not permitted to take her back even if he had pronounced talaq under the influence of any intoxicant, unless his wife undergoes nikah-halala, talaq, marries another man, consummates the marriage, and gets divorced again in order to be able to remarry her former husband Polygamy allows a Muslim man to have four wives, and once a Muslim woman has been divorced, her husband is not permitted to take her back which involves her marriage with another man, who subsequently divorces her so that her previous husband can re-marry her. The petitions have been filed by Muslim women and advocate Ashwini Upadhyay challenging the constitutional validity of polygamy and nikah halala. These cases were referred to the five-judge bench by a three-judge bench in March 2018.In August, the apex court had issued notice to the Centre, National Commission for Women, National Commission for Minorities, Law Commission etc., and scheduled the matter for hearing after Dussehra holidays. Upadhyay's plea said the injury caused to women as a reult of the practice of triple talaq, polygamy and nikah halala is violative of Articles 14, 15 and 21 of the Constitution and injurious to public order, morality and health. The plea sought a direction to declare Section 2 of the Muslim Personal Law (Shariat) Application Act, 1937, unconstitutional and violative of Articles 14, 15 and 21 of the Constitution, insofar as it seeks to recognise polygamy and nikahhalala. “It is well settled that common law has primacy over personal law. Hence, this court may declare that triple talaq is cruelty under Section 498A of the IPC, nikahhalala is rape under Section 375 of the IPC, and polygamy is an offence under Section 494 of the IPC,” Mr Upadhyay's plea read. In August 2017, the top court had held that the practice of triple talaq is unconstitutional and struck it down by 3:2 majority. In its 2017 verdict, the apex court had kept open the issue of polygamy and nikahhalala, while quashing the practice of triple talaq. “It is submitted that religious leaders and priests like imams, maulvis etc., who propagate, support and authorise practices like talaq-ebidat, nikah-halala and polygamy are grossly misusing their position, influence and power to subject Muslim women to such gross practices which treat them as chattel, thereby violating their basic rights enshrined under Articles 14, 15 and 21 of the Constitution,” Mr Upadhyay's plea read. Questioning Goel's appointment in a super-fast manner, the Bench remarked that in less than 24 hours, the process was completed and notified ically questioned the AG on the criteria adopted by the Law Minister in picking four names from the DoPT's database. The Bench noted that the Minister picked the names and the file was put up on 18 November and moved the same day. The Bench told the AG: “Even the Prime Minister recommends the name on the same day. We don't want any confrontation...” It further pointed out that the post was vacant since 15May, and asked the AG to show what caused the government to do things at this lightning speed. Justice Joseph reiterated that the court is concerned about a ‘yes man’ being appointed and asked what is the basis of the Law Minister shortlisting four names from data of hundreds of people following the age criteria. The sign boards were installed outside each of the mosque's three entrances. However, no restriction has been imposed on married couples or families entering the mosque. Mr Modi had launched the concept of “Rozgar Mela” at the central level on the occasion of Dhanteras. This was the beginning of the campaign to provide ten lakh jobs at the level of the central government. Since then, Modi has addressed the “Rozgar Melas” of Gujarat, J&K and Maharashtra governments, and also launched a “Karmayogi Prarambh” module for online orientation courses for all new appointees in various government departments. He distributed about 71,000 appointment letters to new recruits the day before. I will not rebel Reacting sharply to Rajasthan CM Ashok Gehlot’s remarks against him in an interview to a TV news channel, former deputy chief minister Sachin Pilot on Thursday hit back at the CM saying, “No person should be so insecure. If we do not remain united then how will we win next assembly polls”. In an interview to news agency ANI, Mr Pilot said: “Even before today, Gehlot ji spoke many things about me, rejected me and called me nakkara and Nikkama (worthless). I want to say that there is no need to make such statements today. It is inappropriate for senior leaders to say such things, it is not right to make allegations. Pakistan President Dr Arif Alvi on Thursday formally approved Prime Minister Shehbaz Sharif’s nominations for the next army chief and Chairman, Joint Chiefs of Staff Committee, hours after receiving a summary in this regard.The confirmation of the president’s approval was given by Defence Minister Khawaja Asif, putting an end to weeks-long speculation. However, an official handout from the President’s office is still awaited. Talking to media persons in Islamabad, Mr Asif said that the advisory sent to President Alvi by the government has been approved. “The president has signed [the summary],” he said, calling it a “good omen”.The defence minister said the process of the army chief ’s appointment had “caused unrest” in the country but the matter was now “settled”. “I believe that all the people, especially politicians, should bring their behaviours under the ambit of the law and Constitution.” After receiving the summary from the prime minister earlier in the day, the president reached Lahore on Thursday afternoon to meet with former prime minister Imran Khan at the PTI chief’s Zaman Park residence, where he is recuperating from injuries he sustained in an assassination attempt. The appointments were announced earlier today by Information Minister Marriyum Aurangzeb on Twitter ~ a tweet which was deleted and swiftly put up again ~ capping weeks of intense speculation on the matter. Bengal CM to visit Delhi STATESMAN NEWS SERVICE KOLKATA, 24 NOVEMBER Chief minister Mamata Banerjee today said that she will go to Delhi on 5 December to attend a meeting called by Prime Minister Narendra Modi on preparations for the G20 summit. India will host the summit in September 2023. Miss Banerjee said that she will attend the meeting in the capacity of Trinamul Congress chairperson and not as chief minister. Three important meetings in connection with this summit are scheduled to be held in Bengal. Chairpersons of all political parties have been invited in the discussion on the G20 summit. So, Miss Banerjee will be present in the meeting as chairperson of All India Trinamul Congress. It is not clear as to whether any one-to-one interaction will be held between Mr Modi and Miss Banerjee. Miss Banerjee said that her Delhi visit assumes special significance for her as she is planning to visit Ajmer Sharif during her tour.
