AGENCIES NEW DELHI, 15 APRIL The Supreme Court on Tuesday expressed its concern over a bail order of Allahabad High Court where it had observed that the victim "herself had invited trouble" and was also responsible for the alleged rape committed on her by the accused. “There is another order now by another judge. Yes, bail can be granted. But what is this discussion that 'she herself invited trouble, etc'. One has to be careful when saying such things,” remarked a bench of Justices B.R. Gavai and A.G. Masih as it dealt with the matter where it had suo motu (on its own motion) stayed another Allahabad High Court judgment holding that grabbing a girl’s breasts and breaking her pyjama string was not enough for charge of attempt to rape. In a controversial order, Allahabad High Court has granted bail to a rape accused, observing that the complainant "herself invited trouble" by agreeing to go to the applicant's house after getting drunk. The Justice Gavai-led India to witness above-normal rainfall this monsoon season AGENCIES NEW DELHI, 15 APRIL India will witness "abovenormal cumulative" rainfall this monsoon, except in some areas over Northwest India, the India Meteorological Department said on Tuesday, ruling out the possibility of El Nino conditions during the entire season. “India is likely to see above-normal rainfall in the four-month monsoon season (June to September) with cumulative rainfall estimated at 105 per cent of the longperiod average of 87 cm,” India Meteorological Department (IMD) chief Mrutyunjay Mohapatra told a press conference here. “The forecast indicates that neutral El Nino-Southern Oscillation (ENSO) conditions are likely to continue during the monsoon season" he added. "The southwest monsoon seasonal (June to September) rainfall over the country as a whole during 2025 is most likely to be above normal ( >104% of the Long Period Average (LPA). India, USA likely to ink first tranche of trade pact before Fall deadline AGENCIES NEW DELHI, 15 APRIL India and the USA are working to sign the first tranche of a Bilateral Trade Agreement (BTA) to bring down tariffs before the agreed timeline of the fall of 2025 as the the terms of reference for the pact have already been finalised. “India and US Bilateral Trade Agreement BTA terms of reference have been finalised when the US team was here. The first tranche negotiations will start virtually on the various chapters within this week, and the talks in the physical mode may start at the end of the month,” Additional Secretary, Commerce, Rajesh Agarwal said on Tuesday. “India has decided to go for a path of trade liberalisation with the USA,” Commerce Secretary Sunil Barthwal told journalists. He said both India and the USA would benefit if the trade deal is wrapped up before the Fall of 2025. “When we said we want to do a first tranche of BTA with the USA by fall, that doesn't mean we can't do it before fall. If we end up doing the BTA before fall, then it will be good for both India and the USA,” he added. If both the countries come to an agreement on reducing tariffs, it would lead to higher trade for USA and India. The 90-day pause is not country specific, it is for everyone. US President Donald Trump paused the implementation of steeper duties for several nations, including India, on 9 April. Commerce Minister Piyush Goyal told journalists last week that "very good negotiations" with the USA were underway. He said that India presents a compelling case to the United States for a bilateral trade deal, given the outlook on growth and demography. “Looking at the growth, India offers in the next 25-30 years with a large, aspirational, young population who will add to the demand for goods and services, we believe India will be a compelling case to enter into a good agreement with the US," Mr Goyal said at a press conference. Bench said that it will hear the suo motu matter, including the plea of the victim’s mother, after four weeks. Staying the impugned part of the Allahabad HC judgment, the apex court, on 26 March, said that the observations depicted a total lack of sensitivity and an inhumane approach on the part of the author of the judgment. “We have perused the said judgment and order dated 17.03.2025. We are at pains to say that some of the observations made in the impugned order and particularly in paragraphs 21, 24, and 26 depict a total lack of sensitivity on the part of the author of the judgment,” it said. “But since the observations appearing in paragraphs 21, 24, and 26 are totally unknown to the canons of law and depict a total insensitive and inhuman approach, we are inclined to stay the said observations," it added. The Supreme Court has registered a suo motu case titled ‘In Re: Order dated 17.03.2025 passed by the High Court of Judicature at Allahabad in Criminal Revision No. 1449/2024 and ancillary issues’ following a letter from senior advocate Shobha Gupta, who urged the Chief Justice of India (CJI) to take cognisance of the observations made by a single-judge Bench of the Allahabad High Court while modifying a summoning order.
